North Dakota uses the federal W-4

North Dakota relies on the federal Form W-4 on file with your employer to calculate state withholding. Employers choose between the percentage method and the wage bracket method in the Office of State Tax Commissioner's 2026 booklet, using the filing status from Step 1(c). Employees can ask an employer to withhold an additional amount; there is no special form for it.

How North Dakota calculates withholding for 2026

For current W-4s the annual percentage method has three layers. A single filer's first $57,625 of annual wages has no North Dakota withholding, wages up to $258,450 are taxed at 1.95% of the amount over $57,625, and wages above that pay $3,916.09 plus 2.5%. Married filing jointly starts at $57,500 and reaches the 2.5% tier at $168,525. Head of household starts at $78,475 and reaches it at $289,675.

For example, a single employee earning $109,850 a year has about $1,018 of North Dakota tax withheld ($52,225 over the threshold at 1.95%). Withholding below $1.00 does not have to be withheld. North Dakota has a reciprocal agreement with Minnesota and Montana, so wages paid to their residents for work in North Dakota are exempt from North Dakota withholding.
